Welcome to Eatalyzer FitLink ("the Application", "we", "us", or "the Developers"). Please read this Legal Disclaimer, Terms of Service, and Privacy Policy ("Terms") carefully before using this software. By accessing, downloading, installing, or using Eatalyzer FitLink, you agree to be bound by these Terms. If you do not agree to all of these Terms, you must not use the Application and must uninstall it immediately.
1. Medical and Health Disclaimer (Not Medical Advice)
- Informational & Self-Tracking Tool Only: Eatalyzer FitLink is designed solely as a personal fitness, nutrition, and exercise logging and informational tool. It is NOT a medical device, clinical diagnostic instrument, or healthcare service.
- No Doctor-Patient Relationship: The Application, its calculations, recommendations, nutritional summaries, calorie estimates, workout plans, and AI coaching suggestions do not constitute medical, nutritional, psychiatric, or healthcare advice, diagnosis, or treatment.
- Consult a Healthcare Professional: Always seek the advice of your physician, registered dietitian, cardiologist, or other qualified healthcare provider before starting any new diet, caloric deficit/surplus, fasting protocol, supplement regimen, weight loss program, or physical exercise routine.
- Emergency Disclaimer: If you experience chest pain, severe shortness of breath, dizziness, faintness, acute physical pain, or any unexpected medical symptoms while exercising or following any dietary program, immediately stop and contact emergency medical services (such as 911 or your local emergency number).
2. Artificial Intelligence (AI) and Machine Learning Disclaimer
- AI-Generated Content: Eatalyzer FitLink includes virtual coaching, conversational assistance, food recognition, and voice logging features powered by Artificial Intelligence (AI) and Large Language Models (LLMs), including Google Gemini, OpenAI models, and on-device machine learning models.
- Potential for Errors & Hallucinations: AI models are probabilistic and capable of producing inaccurate, incomplete, misleading, or outdated information ("hallucinations"). AI nutritional estimates, macronutrient counts, and workout suggestions are approximations and should never be relied upon as absolute facts.
- Independent Verification Required: You must independently verify any critical nutrition or workout information generated by AI. The developers do not guarantee the accuracy, completeness, or safety of AI-generated responses.
- Third-Party AI Providers: When you configure and use your own Google Gemini or OpenAI API keys, your prompt inputs and shared media (such as food photos and voice transcripts) are transmitted directly to the respective AI provider under their terms of service, content policies, and privacy disclosures.
3. Nutrition, Barcode, and Allergen Warning
- Approximations: Food databases, barcode lookups, portion estimation tools, and calorie calculations are estimates based on standard nutritional databases and public sources. Actual nutritional values vary by manufacturer, preparation method, and serving size.
- Allergen Alert: The Application CANNOT guarantee allergen detection or prevention. If you or anyone you prepare food for has food allergies, celiac disease, intolerances, or severe dietary restrictions, you must physically inspect food packaging labels and contact food manufacturers directly. Do not rely on camera scans, AI descriptions, or database entries for allergen safety.
4. Physical Exercise and Injury Assumption of Risk
- Inherent Risks of Physical Exertion: Weightlifting, resistance training, cardiovascular exercise, stretching, and physical conditioning carry inherent risks of muscle strain, joint injury, cardiovascular events, bone fractures, and in rare cases, permanent disability or death.
- Voluntary Assumption of Risk: You voluntarily choose to perform any exercises or routines tracked in or suggested by the Application. You assume full responsibility for your physical safety, warmup, proper technique, equipment inspection, and training environment.
5. Privacy Policy & Data Handling Disclosures
We believe in user privacy and data transparency. Below is an exact accounting of how your data is handled:
A. Data Categories & Local Storage
- Health & Fitness Data: Your profile information (age, gender, height, weight goals), weight logs, body fat percentages, workout routines, exercise sets, and daily food logs are stored locally on your device in a private SQLite/Room database.
- No Proprietary Cloud Accounts Required: The Application does not require creating a proprietary third-party account to track your fitness.
B. Google Health Connect Synchronization
- If you explicitly grant permissions, the Application reads and writes fitness data (such as weight, nutrition, exercise sessions, and total calories burned) via Google Health Connect to synchronize with compatible apps (like Google Fit, Fitbit, or Samsung Health).
- You can revoke Health Connect permissions at any time via your Android System Settings.
C. AI Processing & Third-Party Transmissions
- If you enable AI features (such as Photo Review, Voice Food Logging, or AI Coach Chat), the relevant input text or food image is transmitted securely over HTTPS to your chosen AI service provider (Google Gemini or OpenAI) using your configured API key or local model.
- We do not sell your personal data or fitness logs to data brokers or advertisers.
D. Backups & User Exports
- The Application provides manual and automatic backup tools that package your local database and preferences into a zip archive or CSV/JSON files. You retain full control and ownership over where you store or share these export files.
6. Terms of Service & Limitation of Liability
- Software Provided "AS IS": Eatalyzer FitLink is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall the Application, its developers, authors, contributors, or distributors be liable for any direct, indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or in any way connected with the use or inability to use this Application.
- User Responsibility: You are solely responsible for ensuring that your use of the Application complies with all applicable local laws, regulations, and health requirements.
7. Updates to these Terms
We reserve the right to modify or update these Terms at any time. When material updates are made, the version date will be updated and the Application will prompt you to review and re-accept the updated Terms before continuing use.
8. Age Eligibility and Children's Privacy (COPPA)
Minimum Age Requirement: Eatalyzer FitLink is intended solely for individuals who are at least 18 years of age (or at least 13 years of age with the express consent and supervision of a parent or legal guardian).
No Children Under 13: The Application is not directed toward, marketed to, or intended for children under 13 years of age. In compliance with the Children's Online Privacy Protection Act (COPPA) and international child privacy regulations, we do not knowingly collect, store, or process personal or health information from individuals under the age of 13.
